Section 08
Mortgage Applications and Financial Privacy
Mortgage and financial information may be subject to federal and state financial privacy laws, including the Gramm-Leach-Bliley Act and related rules. Certain information handled in connection with providing a financial product or service may be governed by separate financial privacy notices and may be exempt from portions of state consumer privacy laws.
When you begin a formal mortgage application, you may be directed to a secure third-party application platform. Information submitted through that platform is also subject to the platform provider’s privacy and security terms and the privacy notices provided in connection with your application.
We use and disclose nonpublic personal information as necessary to process or service a transaction, prevent fraud, comply with law, and for other purposes permitted by applicable financial privacy laws.
Section 09
Email, Telephone Calls, and SMS Communications
When you provide contact information, we may use it to respond to your request and, where you have provided appropriate consent, to send informational, transactional, or marketing communications.
Message frequency varies. Message and data rates may apply. Consent to marketing calls or texts is not a condition of obtaining mortgage services.
You may opt out of marketing email by using the unsubscribe link in the email. You may opt out of text messages by replying STOP. For assistance, reply HELP. You may also contact us at 949-787-2662 or pcollins@emortgagecapital.com.
After an opt-out request, we may send a confirmation and may continue communications that are legally required, non-marketing, or necessary to service an existing request or transaction.
Section 10
Artificial Intelligence and Automated Tools
We may use artificial-intelligence-assisted or automated tools to support administrative tasks, customer service, document review, content development, data organization, fraud prevention, quality control, and business operations.
We do not rely solely on automated decision-making to make a final lending decision. Credit and underwriting decisions are made under applicable lender, investor, underwriting, and legal requirements.
Information processed through AI-assisted tools remains subject to applicable privacy, security, contractual, and legal requirements. Do not submit highly sensitive financial information through a general-purpose chatbot or unsecured communication channel.
Section 11
Data Security and Retention
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No website, email system, text message, or data-storage method can be guaranteed to be completely secure.
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, service a transaction, maintain business and compliance records, resolve disputes, enforce agreements, and satisfy legal, regulatory, tax, licensing, and recordkeeping obligations.
Retention periods vary depending on the type of information, the nature of the relationship, applicable law, and whether information is needed for an active or reasonably anticipated legal or regulatory matter.

- Confirm whether we process your personal information and request access to it.
- Request correction of inaccurate personal information.

- Opt out of the sale or sharing of personal information, targeted advertising, or certain profiling.
- Limit certain uses or disclosures of sensitive personal information.

To submit a request, email pcollins@emortgagecapital.com with the subject line “Privacy Request,” or call 949-787-2662. Describe the right you wish to exercise and the information or interaction involved.
We may need to verify your identity and authority before completing a request. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and direct verification with the consumer. We will respond within the period required by applicable law.
Privacy rights may not apply to information covered by an exemption, including certain information governed by federal financial privacy law, or where retaining information is required or permitted by law.
Section 13
California Privacy Disclosures
California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including rights to know, access, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive equal service and pricing when exercising applicable rights.
Categories Collected
During the preceding 12 months, we may have collected the categories described in this policy, including identifiers, customer records, protected classification information voluntarily provided in connection with a mortgage inquiry, commercial or transaction information, internet activity, geolocation derived from an IP address, professional or employment information, inferences, and sensitive personal information needed for a mortgage or financial-services request.
Business Purposes and Recipients
We collect, use, and disclose those categories for the business and commercial purposes described in Sections 4 and 5. Recipient categories may include service providers, mortgage and transaction participants, affiliates and authorized personnel, government or legal recipients, and parties you direct us to involve.
Sale, Sharing, and Sensitive Information
We do not sell personal information for monetary consideration. If any online advertising or measurement activity is considered “sharing” or “sale” under California law, you may exercise an applicable opt-out right by contacting us or using a legally recognized browser-based opt-out preference signal.
We use sensitive personal information only for purposes reasonably necessary to provide requested services, process or support mortgage transactions, protect accounts and systems, prevent fraud, verify information, and comply with law. We do not use sensitive personal information to infer characteristics about you for unrelated purposes.
California “Shine the Light”
California residents may request information about certain disclosures of personal information to third parties for their direct-marketing purposes. We do not disclose personal information to unrelated third parties for their own direct marketing in the manner covered by this law.
Section 14
California Do Not Track Notice and Global Privacy Control
Do Not Track
Some browsers offer a “Do Not Track” signal. Because there is no universally accepted standard for responding to traditional Do Not Track signals, this website may not respond to those signals in a uniform manner.
We do not knowingly permit unrelated third parties to collect personal information from this website for their own purposes unless you provide the information directly, authorize the disclosure, or the collection is otherwise disclosed and permitted by law. Third-party analytics, social, embedded, or advertising services may collect browser or usage information under their own policies.
Global Privacy Control
Where required by applicable law, we recognize a valid Global Privacy Control signal as a request to opt out of the sale or sharing of personal information associated with the browser or device sending the signal.
Section 15
Children, Third-Party Links, and Users Outside the United States
Children’s Privacy
This website and our mortgage services are intended for adults. We do not knowingly collect personal information from children under 13 through this website. If you believe a child has provided personal information, contact us so we can review and delete it as appropriate.
Third-Party Websites and Services
This website may link to or embed services operated by other companies, including application platforms, scheduling tools, social networks, calculators, and external resources. Their privacy practices are governed by their own policies. Review those policies before providing personal information.
United States Operations
This website and the related services are directed to users in the United States. Information may be processed and stored in the United States, where privacy laws may differ from those in other countries.
Section 16
Changes to This Policy and Contact Information
We may update this Privacy Policy from time to time to reflect changes in our practices, services, technology, legal requirements, or business operations. The “Last updated” date at the top of the policy shows when the latest revision became effective.
Material changes may be communicated through the website or another appropriate method. Your continued use of the website after an update is subject to the revised policy.
